They have nothing to gain by going after people downloading TV shows, including anime series. Really, it comes down to what your moral values tell you is right and wrong. I don't think fear should dictate what you do in this case, but rather what you feel is right. We all know that once the product is liscensed, it is most definitely wrong to download it, but when the program is unliscensed, do what you think is right based on your beliefs. Personally, I have no problem with people downloading unliscensed anime because some of it will never make it out of Japan otherwise.

Let's say you download a TV show that isn't sent in your country yet, but is gonna be sent there later. Is this illegal? IMO, no. But anime is a little different, as they are not sent on any TV stations (or none in my country :p), and then I would think of it as illegal, IF you don't plan to buy it when available on DVD.
Movies is a little different, but there I download movies that is been sent on TV in my country before, and I've had the possibility to record myself. But sometimes newer movies too, though :p
I don't either think it's illegal to download a game to try it, if there is no demo version.
